Your assigned Amicus Brief concerns a case recently granted certiorari by the United
States Supreme Court. The case is Gonzalez v. Google, LLC. The case is joined together
with two similar cases where different plaintiffs are also suing other social media
platforms, Twitter and Facebook, alleging similar facts and circumstances. However, your
assignment will be to consider only Gonzalez v. Google, LLC.
Under a section of the Communications Decency Act, 47 U.S.C. 230, an Internet Service
Provider cannot be held responsible for content posted by users of the platform. In the
Gonzalez case, the Gonzalez family plaintiffs argue that Google posted information about
ISIS, a terrorist group responsible for the 2015 attack and shooting death of Mrs. Nohemi
Gonzalez, an American citizen, in Paris, France. They allege that Google was responsible
for radicalizing people who viewed the Google content and for recruiting people for ISIS,
supporting terrorism that resulted in Mrs. Gonzalezàdeath.
You will need to review the Antiterrorism Act and the Communications Decency Act for
background, as well as the Ninth Circuit decision in the Gonzalez case, and then decide
whether you will write your Amicus Brief to urge the High Court to rule in favor of the
Gonzalez family or in favor of Google.
