For this assignment, you will take on the role of an HR manager and review various case studies [5.1, 5.3, and 5.4 in the textbook (Pages 159-161)] concerning compensation and benefits. Within the case studies, you will.
Evaluate which compensation and benefit laws best apply to each scenario.
Provide a rationale for each of your decisions. For your rationale,
- Explain how the situation meets each element that needs to be proven or satisfied under the specific law.
- Assess possible arguments against your position and counter those arguments with a minimum of three scholarly and/or credible sources.
Textbook: Remington, J., Heiser, R. T., Smythe, C., & Sovereign, K. (2012). Human resources law (5th ed.). Pearson. Please be sure to cite this textbook since this is where the case studies that are attached came from 🙂
- Let’s get ready for your paper. You must read the cases on pages 159-1615 (5.1, 5.3, and 5.4). Be careful, as many students do not find the cases and write about other cases. I have added a PDF containing the three cases you need to write about. These cases are discovered after section 5.7 in the textbook at the end of the chapter. - These cases concern meal and break periods, exempt and non-exempt, and forced vacations, which are all compensation issues, and how to protect the employer, as well as the employees, so do not be one-sided from the POV of the employee only. As HR leaders, our role is to protect the company by enforcing the laws of our land and advocating employee rights. Please research these concepts for federal and state laws and county/city laws, as that will show the depth of your knowledge on these familiar topics. I have added several sources for you to use, as this has been discussed in the new company where I am a CHRO. You may use these resources in your papers.
- This paper needs to be a minimum of three full pages Times New Roman Size 12 Font Double-Spaced APA Format Excluding the Title and Reference Pages. Here is the flow on how you need to answer each case review:
I. Opening should discuss the Department of Labor and its purpose and how compensation impacts employee morale, fairness, and employee worth and retention.
II. Case One Review should include a level header
Para.1: introduce the case facts in the first paragraph
Para. 2: what law does this case underscore? For example, case 5.1 is about meal breaks under the Department of Labor’s Wage and Hour Division, so read about that on the DOL website for references, along with the textbook’s information on meals/breaks. Use citations!
Para. 3: Consider, as an HR manager, what changes you would institute. Think from the employee’s and manager’s views on how you would explain to an employee why this company policy is essential. Check your company policy and analyze what they have and what you are learning as another aspect for paragraph three.
Para. 4: Assesses Possible Arguments Against Your Position and Counter Those Arguments
III. Repeat the same three paragraphs above for the following two cases.
V. Closing should include several sentences on what was learned and a message to your CEO from you as the HR Leader on why this topic is essential.
Make sure you include references and in-text citations. Remember that in-text citations are required for this assignment, so if you have three (one for each case), this will earn a proficient rating, and if you have four (one in the opening paragraph), this will reach a distinguished rating.
