Week 3, Discussion.

Each corporation has its own identity, culture, and brand that it is selling. What problems occur when someone who does not fit the ideal representation of that corporation seeks employment? In other words, do you think that a corporation should be able to have a certain style or “look” that it wants to represent their brand, and therefore hire employees who adequately represent this?

I don’t think that a corporation should hire workers based on a certain look because there are different races/cultures, religions, disabilities and so forth. The United States is full of diversity so why would a corporation hire only a certain look? That will offend so many people. and if it does that they could lose a lot of money being that different all diversities may shop at the corporation.

Do you agree with the way that the courts ruled in the cases you reviewed? Why/why not?

In the case of the Muslim woman name Samantha, who was rejected at an interview for wearing a hijab, worn by many Muslim women for religious reasons was discriminated against. I agree with the Supreme Court ruling in her favor in an 8-1 decision in the important religious rights case.

Finally, watch Abercrombie and Fitch Under Fire xclusionary®bsp;Tactics, and discuss whether or not you feel that it is discriminatory for companies to exclude certain groups from their merchandise (i.e., Not sell products to certain customers). Be sure to use examples from the resources to back up your argument.

After watching the video my question is why are they still in business? When you first walk into their stores you are greeted by a shirtless male which may give a little sexist look. If i was a straight man I wouldn’t be comfortable shopping in a store with shirtless men standing around. I do think they realized that selling items for skinny people was really wrong due to the fact that sales dropped. Plus they took the shirtless men out of the stores.

As a small business owner, I know I am solving a problem and requesting a financial exchange from the consumer. I am also well aware that the employee and the customer must be properly taken care of. The customer matters because their purchase makes more money for the owner. Employees matter because they engage the customer with service that yields financial results. At the end of the day, every corporation exists to make money.

I grew up in the military and was always used to seeing men and women in uniforms. Each service member had to abide by their branch’s dress code both in and out of uniform while on the base facility. Dress codes are necessary for employees because it brings a level of p[professionalism and uniformity. 2ess codes are typically implemented by school districts and employers to promote learning, safety, and image. Although such regulations face First Amendment challenges by students, parents, and employees, the courts generally support the schools and employers®bsp;(Carey, n.d.). Since Title VII of the Civil Rights Act prohibits employment discrimination based on race, color, religion, sex, and national origin, a corporation’s obligation to humanity is to keep its /ok policy®bsp;in compliance with the laws of the land (Title VII of the Civil Rights Act of 1964, n.d.). Furthermore, the Americans with Disabilities Act 2ohibits discrimination on the basis of disability in employment, State and local government, public accommodations, commercial facilities, transportation, and telecommunications. It also applies to the United States Congress®bsp;(Guide to disability rights laws, 2022).

For me, the /ok policy®bsp;from Abercrombie & Fitch is discriminatory. While a corporation should have a certain culture, identity, and brand, it should not infringe on a person’s religious rights or physical disabilities. Policies are necessary but should not contain preferences for a certain /ok®bsp;that causes unfairness. In the article by Hurley (2015), I was astonished that the 10th U.S. Circuit Court of Appeals in Denver ruled in favor of Abercrombie before the high court backed Elauf. The discussion question mentioned employees who dequately®bsp;represent the corporation. Yes, I believe adequate representation is great as long as the laws of the land are not violated. A religious garment and a woman with a prosthetic are adequate candidates for hire according to the law.

The courts upheld the law; therefore, I agree with the ruling to defend the rights of those who were discriminated against, marginalized, and dehumanized. Discrimination, unfortunately, is everywhere we turn, whether overt or covert. Any type of discrimination on any level in any organization should face outrageous consequences and zero-tolerance concerning discrimination in the workplace.

The CEO of a company tends to be the personality of the stores. David T. Abercrombie founded the store in 1892. It was a store for those who enjoyed the outdoors. The store has a long history of growth and lack. Netflix did a documentary, “White Hot: The Rise & Fall of Abercrombie & Fitch” (Netflix Film, 2022). After watching the video bercrombie and Fitch Under Fire xclusionary Here are my reasons according to ABC News (2013); the CEO admitted to leaving out the population of people who are larger than a size 10, even though the average-sized woman in the United States is a size 14. In a 2006 álon Magazine®bsp;interview, Mike Jeffries, the CEO said, å go after the attractive All-American Kid. A lot of people don belong in our clothes, and they can belong. Are we exclusionary? Absolutely.®bsp;Of the shirtless salesman who fits the ïol, young, and sexy®bsp;troupe, how many of them are of the BIPOC community? Are there no cool, young, and sexy people outside of young, thin, and white people? WOW! This is outrageous.
